kicked out and needing advice!

my mom recently kicked me out. i did not have time to get all the things i needed. now she won't let me back. i can call the cops and have her let me in to get my stuff but not everything because i can't take it with me yet..but the question is this:

will the cops tell me to take it all or leave? i'm afraid they will tell me i need to take it all or my parents have permission to do with they want with it. it's my stuff though.

now what if she refuses to give me my mail but puts "return to sender" on it? is that tampering with my mail? or not? because i want it, i don't want her to send it back.. i know it's illegal to tamper with mail, but idk what that exactly means. is sending it back tampering because i said no, or is it fine? google isn't helping me in this matter..

Tampering only means she is not allowed to open it if her name does not appear on it. It IS legal for her to put "return to sender" or "not at this address". If you want to avoid her doing that, you need to either get a PO Box or ask a friend if you can have your mail forwarded to that address and then fill out a "change of address" form.

that's what i figured. everything is so complicated. i'm not moved to where my newest residence will be. it's two hours away. i have to wait until next week to do that. so i guess i have to deal with delayed bills. great. thanks :]

acutually she can only cross out the address. We found out while living in TX the last time that writing anything on an envelope that is not addressed to you is tampering with the mail. You legally can only cross out the address *shrugs*

Go to the nearest post office to your house [the one that delivers your mail] and start a PO box.
The small ones are like ten dollars a month and you can have your things forwarded to you.

As for your things.
When my parents split up, and my dad kicked my mom out. She called the cops and they stayed there while she came in and took all of her things.
They let you have your stuff, it's yours after all.
Especially clothes.

Well the ones that came to my house just stood in the living room, to make sure there was no like fighting, etc. I'm sure one would go with you, if you asked them to.

My dad had pretty much put all of her things together though, so she really just had to come in and get the bags of clothes. =/

i got a lot of my clothes out before i left. i have certain things i want. papers, documents. no one knows where they are. i have tons and tons of books. i have stuff that is not packed. there are some clothes that i want that i didn't get to bring with me. :[ i don't really want them to follow me around. my room is a mess, lol.

I don't see why they would. I'd think the most they would do is stand outside your door maybe.

It's not illegal, you need to change all your mail re-directed to a friends or somewhere. They'll just tell you that is your responsibility.

Go to the post office and get your mail redirected to a friend's house or a PO box. Do this right away and it can be put into effect almost immediately.

how long did you live in the house? Even though you are not a minor - they cannot illegally evict you. Which is what it sounds like they have done if they have not gone through the whole court process.

generally speaking the police will not follow you room to room, unless they feel there is a real need to (dispute between your parents and you as to whether its yours or not type of thing)

its not an eviction unless hse signed a lease and paid rent. if its her parents house, and nothing was signed, they have every right to kick her out anytime. (not saying its right, jusy sayin)
it is also not illegal to write return to sender or not at this address on mail that isnt yours.

get a storage place, get a temp po box, and THEN call the police to go get your stuff. the mail will take anywhere from 5-15 days to be forwarded....paper work and all.

In order to evict a tenant in Philadelphia, a landlord is required to give the tenant a written notice. If a tenant is being evicted for non-payment of rent, unless otherwise specified in the lease, the landlord must give a ten (10) day written notice. However, sometimes the lease “waives”, or sets aside, the right to a notice. The same is true if there is a word of mouth lease agreement. All tenants have a lease of some kind; if the lease is not in writing, the law assumes the tenant to have an oral lease, or a lease created by the action of the landlord and tenant. For example, the action of paying rent to live in a property.


If a tenant is being evicted for any reason other than non-payment of rent, and the lease does not say how much notice is required, the written notice must be 15 days if the lease is for one (1) year or less; if the lease is for more than one year, thirty (30) days written notice is required.

that would only apply IF she paid them rent....and had proof of that payment, otherwise, whos to say.
i dont believe the landlord tenant deal applys to PARENTS who have their child living with them, no matter the kids age.
i could be worng...and if i am, there is something seriously wrong with the system!!!
if a kid is sucking off their parents, and they have no real recourse to move them out, well thats plain ass bullshit.
not saying thats whats happening here...but the way i see it is it MY home, IM paying for it, therefore, the kid has no right to stay if i say go.
but thats me. (and not something i can see myself doing.....well, it would take a whole lot for me to kick one of my kids out)
not to mention that if her mom doesnt want her there, for whatever reason, what good would it do to fight this? nadda. zip. zilch.
i say, be the bigger person and move on. rent the storage space, get a po box (as i mentioned before) and just move on.

I had that same problem more than once.

You have every right to call the police, and they will be there the whole time while you get your things.

Also, if you dont any place to put all your things, you can try getting a storange space for the time being, which you probably will have to pay monthly on it.
Or ask a friend that has a garage or extra room if you can store your things there.
