discrimination? you decide. An email

07/08/2012

I'm editing this after 3 notes.
This is just one example of a job advertizement. What I have found is tht people put the driver's license requirement as a big stamp on every job without thinking of the actual job requirements.
Why would you need to drive in order to work at a hospital? ...for example.

Subject: ADA-driver's license

To whom it may concern:

My name is Jonathan Alpert. I live in the Boston Massachusetts area. I am a master's level mental health counselor seeking fulltime employment.

I came across a job advertisement on usajobs.com from your department. I am perplex by what I have found and unfortunately, it's far from the first time I have seen the following:

On the va.gov website, it states "Special Employment Consideration: VA encourages persons with disabilities to apply."

However, it also states "NOTE: Applicant must have a current, unrestricted driver’s license."

I am disabled. I am blind but I obviously do not and cannot have a driver's license. This has held me back from obtaining fulltime employment. I feel that this is a discrimination against people who have a vision disability.

How can I and the millions of other people in America who has a vision disability obtain employment with the driver's license restriction?

All I want is to be an employed member of society.

It isn't discrimination it is clearly a requirement of the job, calling that discrimination means any job where sight is a requirement is therefore discrimination.

If it is a job that requires driving, then I say it is not discrimination, it is merely a qualification that you do not meet. However, if it is a job that does NOT require driving, then that definitely sounds like discrimination to me. The requirement of it being an unrestricted license seems like the job requires driving.

What mixie said. If it's plain ol' discrimination, I've got TONS of information on ADA (with you might already know about) if you need.

From what you told me before. I agree with Mixie and derdoppelganger. If the job your seeking will keep you in one place then yes I feel they are discrimation againt you. However, if they require you to go to different sites, then no I don't think they are. Sorry hun, I do hope one of these places hire you and don't need you to go anywhere.

I've sometimes seen that listed so that companies can try to require that people have a valid and reliable mode of transportation to work. We don't require it at my company and it's amazing how many employees tend to be late because they missed their bus or the buses were running late.

I think it was just a mix-up, and a valid ID would have done.

lol, I'm not a woman...

Yeah, let me comb through my ADA stuff and I'll get back to you. I have a friend who also knows a lot about that stuff, so I'll ask her and see what the best course of action for you would be. That's totally ridiculous that you can't find someone to hire you. That's why the Americans with Disabilities Act exists.

I'd say it is discrimination. Unless a license is required for the job itself, it shouldn't even be in consideration.

I know how difficult it can be for someone with outwardly obvious disabilities to find work. I've noticed many of my friends with physical or obvious mental disabilities find it nearly impossible to find anything, yet those with less obvious disabilities rarely run into issues. It's so stressful for them. Kudos for speaking up about it! I wish more people did.

what happened to 'reliable transportation' ????????????

[~Kimberly~|0 likes] [|reply]

Jobs require independent travel over substantial distances that cannot be fulfilled with the use of public transport or by relying on other people to drive you around.

ryc-employers need to know that you will be able to reliably get to work...hence, a drivers license or in the least reliable transportation.
